Acceptable Use Policy

This Policy is issued by ARKVAS LLC ("ARKVAS").

This Acceptable Use Policy ("Policy") applies to all users of the Arkvas platform, including the website, assessment, dashboard, support ticket system, and any other features or communications channels offered through the Services.

This Policy is incorporated into and forms part of the Arkvas Terms of Use. Capitalized terms not defined here have the meanings given in the Terms of Use. Violation of this Policy may result in account suspension, permanent termination, forfeiture of dashboard access without refund, and where appropriate, referral to law enforcement authorities.

1. Platform Use Standards

Arkvas is an informational platform. Users agree to use the platform only for its intended purpose — exploring publicly available U.S. immigration information — and in a manner consistent with all applicable laws and these standards.

You may not use the platform to:

  • Submit fraudulent, deceptive, or intentionally abusive responses for the purpose of manipulating, abusing, or interfering with the platform
  • Attempt to reverse engineer, extract, copy, or reproduce the assessment logic, pathway scoring methodology, or any proprietary content for commercial or competitive purposes
  • Use automated tools, scripts, bots, crawlers, or scrapers to access, query, or extract data from the platform without express written permission
  • Impersonate any person, immigration attorney, government official, or entity, or misrepresent your qualifications, identity, or affiliation
  • Use the platform to assist, facilitate, or encourage the unauthorized practice of immigration law, including providing immigration legal advice to third parties using content derived from the platform
  • Access the platform on behalf of another person for commercial gain without express written permission from Arkvas
  • Attempt to probe, scan, or test the security or vulnerability of the platform or its underlying infrastructure
  • Introduce malware, viruses, or any code designed to disrupt, damage, or gain unauthorized access to the platform or its systems
  • Use the platform in any way that could expose Arkvas, its users, or any third party to legal liability

Users may not upload, transmit, or submit unlawful, fraudulent, malicious, or unauthorized documents or materials through the Services.

2. Support Ticket System and Communications Standards

Arkvas provides a support ticket system within the dashboard to assist users with platform-related questions and issues. All communications through this system, including support tickets, emails, and any other channel through which users contact Arkvas, are subject to the following standards.

Users agree to communicate with Arkvas staff in a respectful and constructive manner. The following conduct is not permitted in any communication with Arkvas:

  • Abusive, threatening, harassing, or intimidating language directed at support staff or any Arkvas representative
  • Discriminatory, racist, sexist, or otherwise offensive language
  • Repeated or excessive contact intended to overwhelm, pressure, or harass support staff
  • Threats of legal action, negative reviews, chargebacks, or public complaints used as leverage to obtain outcomes outside of Arkvas's published policies
  • Submission of false or exaggerated complaints intended to manipulate refund or dispute outcomes
  • Sharing, publishing, or distributing the contents of support communications without Arkvas's prior written consent

Arkvas support staff are authorized to end any communication that violates these standards. Repeated violations may result in account suspension or termination. Arkvas reserves the right to maintain records of abusive communications and to use them in any dispute resolution or legal proceeding.

3. Reporting Misuse

If you believe another user or third party is misusing the platform, violating these standards, or engaging in conduct that harms you or others, please contact Arkvas through the support ticket system or at the email address listed below. Arkvas will investigate reports in good faith and take appropriate action, which may include account suspension, termination, or referral to relevant authorities.

Arkvas does not guarantee a specific outcome or response timeline for all reports but will prioritize reports involving safety concerns, threats, or potential legal violations.

4. Consequences of Violation

Violations of this Policy are taken seriously. Depending on the nature and severity of the violation, Arkvas may take one or more of the following actions without prior notice:

  • Issue a formal warning to the account holder
  • Temporarily suspend access to the platform or specific features
  • Permanently terminate the account
  • Forfeit any dashboard access purchased and cancel any active Policy Alert Subscription, without refund, where termination is for cause
  • Preserve and produce records of the violation in connection with any legal or regulatory proceeding
  • Refer the matter to law enforcement or regulatory authorities where the conduct may constitute a criminal offense or regulatory violation

Arkvas's decision on enforcement actions is final. Users who believe a termination or suspension was made in error may submit a written appeal to the contact address below within 14 days of the action. Arkvas will review appeals in good faith but is not obligated to reinstate access.

5. No Tolerance for Immigration Fraud

Given the nature of the platform, Arkvas takes a particularly firm stance on any conduct related to immigration fraud, misrepresentation, or the unauthorized practice of immigration law. This includes but is not limited to:

  • Using platform content to prepare or assist in preparing fraudulent immigration filings
  • Misrepresenting assessment results or pathway summaries as legal determinations to third parties
  • Using the platform to impersonate a licensed immigration attorney or accredited representative
  • Attempting to use the platform to facilitate document fraud, identity fraud, or misrepresentation to any government agency

Arkvas will cooperate fully with any government agency, law enforcement authority, or bar association investigating conduct of this nature. No account confidentiality or privacy protection extends to communications or conduct that facilitates immigration fraud or unauthorized practice of law.

6. Changes to This Policy

Arkvas may update this Policy from time to time. Material changes will be communicated in accordance with the Terms of Use. Continued use of the platform after changes take effect constitutes acceptance of the revised Policy.
